Pool season is finally here! The swimming pool facility will open to Outside Memberships May 25, 2024, for the season, which ends September 2, 2024.  (Note that only the Cobblestone Pool will be open for the September 7th & 8th weekend. ) Pool hours.

Please complete all of the information requested on the Electronic Pool Passes form to ensure receipt of your passes before pool opening day. You are encouraged to complete this as soon as possible.

As always, Vanguard Management will work with you to provide efficient service throughout the pool season.

In order to receive your Electronic Pool Passes, you must meet the following qualifications:

  1. You must live in or own a home in the community.
  2. Your assessments must be current. If you have questions about your account, contact Vanguard Management’s accounting department at 301-540-8600 X3303.
  3. Your home must not have any outstanding maintenance/architectural violations.
  4. The homeowner must complete the online registration.  If you are a tenant, please contact the homeowner and encourage them to complete the registration.

Electronic Pool Passes

The Board of Directors for the Whittier Community Association is pleased to announce the continued use of the electronic pool pass system for the 2024 summer season. The pools will open on Saturday, May 25, 2024. This year, we will again use an online registration and virtual ID process for pool access – this means NO MORE PHYSICAL CARDS to lose! Additionally, homeowners DO NOT need to re-register each year unless there are changes to the household.

Homeowners that have not signed up previously must complete the online pool registration. If you are a tenant, please note that the homeowner must complete the registration process and authorize your use of the pool. If you are a homeowner with new tenants, you must first remove the prior tenants from the system and then add your current tenants. Tenants can reach out to their landlords to help with this process by providing names and other registration data. Homeowners can sign up and register using: whittier.cellbadge.com/Register your computer, smartphone, or tablet.

Registration Instructions. This is a multi-step process!

  1. Sign up as a new member using the GREEN BOX
    • Please use the property address in Whittier.
    • Once you submit your basic information, it is sent to the management/pool administrator to confirm that you are a homeowner in Whittier.
    • You will receive a text/email once your information has been validated.  At this time, your final registration is PENDING until you update your household members (see below).

  2. After you receive your text/email, return to: whittier.cellbadge.com/Register using the BLUE BOX “Registered Previously or Approved” and enter your email address and phone number to get your unique PIN to authenticate your account.
    • You will receive a PIN via text and email.  Enter the PIN to continue the process.
  3. After entering your PIN, you will be taken to the POOL REGISTRATION page:
      • Register every member of your household (first and last name and age category).
      • Once you submit your information, your registration is sent to the pool administrator/community manager for final approval.
      • You will receive a confirmation text/email to notify you when your registration has been ACCEPTED.
      • At your first visit to the pool, a lifeguard on duty may take your photograph to accompany your registration and complete your household record.
  4. After this process is complete, your access to the pool for the remainder of the season will be quite simple. No pass is required – just check-in with the lifeguard by providing your name and address, and they will be able to access your “virtual ID card” and photo and allow access to the pool. This new process takes the place of the old pool pass system.
  5. Guest passes: residents will receive 10 “virtual guest passes” for use at the pool during the summer. All other guest rules, including the maximum number permitted per resident, remain in place.

 

General Pool Information and Reminders

You are encouraged to go online to complete the application process as soon as possible.

Any online registrations received after May 17th will be processed as quickly as possible but are not guaranteed to be processed before the pool opens. 

The 2024 Pool Guidelines and Statement of Understanding; Assumption of Risk; Waiver of Liability and Indemnification Agreement are not included in the package; however, all homeowners who complete the registration process acknowledge and agree to the pool rules and Agreement. If you are renting your home, you must provide these documents to your tenants. By adding them to your registration you certify that your tenants also agree to adhere to the pool rules and Agreement. Incomplete registration requests will be rejected to the applicant and must be resubmitted to include all missing information. Please note that this will delay the processing and completion of your registration.

In order to receive approval for pool access, you must meet the following qualifications:

  1. You must live in or own a home in Whittier.

Pool Season is almost here! The Whittier Community Association is offering outside memberships to interested swimmers because of the available capacity at the community swimming pool facilities.

The swimming pool facility will open to Outside Memberships May 25, 2024, for the season, which ends September 2, 2024. Membership will entitle a family of up to six (6) members or an individual to full swimming privileges at any of the three (3) Whittier Community pools. Costs for each type of membership are:

The link above you will find your Pool Pass Application, along with instructions to assist you in completing the application and the Guidelines governing the use of the pool. Please fill in all the information requested on the application form. Incomplete applications will be returned to the applicant for completion of all missing information. Please note that this will delay the processing and mailing of your pool passes. You are encouraged to read the rules and regulations carefully as you must sign the application agreeing to abide by all rules.

Please remember to include your check made payable to “Whittier Community Association” when you return your application. Passes will not be activated until payment is received. Once the application and payment have been received, you will be entered into the electronic pool pass system and receive an email confirmation that you have valid passes.

Please read the following instruction pages carefully for instructions on completing and sending your pool application for the 2023 pool season. There are a limited number of swimming pool memberships available; therefore, all applications will be processed on a first-come, first-served basis.

INSTRUCTIONS

1. Complete the application.

PART A: Homeowner Information

  • Enter your name.
  • Enter your complete address.
  • Enter the applicant’s home and work phone numbers.

PART B: Residents at this Address

  • Enter the first and last names of everyone living at this address.
  • Check the appropriate age box for each person according to his or her age on July 1. Adults – (16 and over) no restrictions; Age 10-15 – must pass a swim test to enter the pool without an adult; under 10 yrs. – may not enter the pool without an adult.

Part C: Signature

The homeowner will need to sign the application agreeing to abide by the rules and regulations posted at the pool and certifying that the information provided on the application is accurate. Applications will not be processed if submitted without appropriate signatures. The pool rules and regulations can be found on this website page.

COSTS

  • This membership entitles family memberships to up to six (6) passes. Two (2) additional passes may be purchased for$85.00 each.
  • Ten Punch Pass – Good for ten guest visits. For each guest that visits with an authorized member, one block will be electronically checked out by the Guards. These passes may be purchased at the time of pool pass application for $15.00. They will also be available for purchase throughout the season at each of the pools. The passes must be paid for by check.

Pool Guidelines

Swimming Pool Application Requirements

  1. The first name, last name and age must be listed for EVERY resident requesting a pool pass.
  2. Please be aware that the Board of Directors reserves the right to require proof of residency for ANY person on an application at their discretion.
  3. The unit owner must acknowledge and agree (and tenant if applicable) to abide by the pool rules and regulations and the Statement of Understanding; Assumption of Risk; Waiver of Liability and Indemnification Agreement which is listed on the pool pass registration, posted on the Whittier website at www.whittieronline.org and posted at the pool.
  4. Only the owner OR tenant can receive pool passes, not both. 

Swimming Pool Rules and Regulations

  1. Authority and Mission Statement:
    1. Conferral of Authority. The pool management staff (the pool manager, assistant manager, lifeguards, and gate attendant), and the Whittier Community Association, Inc. Board of Directors (WCAB), have absolute authority for the operational and safety conditions of the pool and the enforcement of the below-listed pool regulations.
    2. Mission statement. The WCAB is committed to ensure that all pool pass-holders and guests, collectively called “patrons,” have a safe and enjoyable experience in accord with Article II, Section 1 of the Association Declaration and Covenants. Any incident or practice that mars such an experience, even if not specified below, should be referred to the WCAB.
  2. Pool admissions:
    1. Admissions in general. Admission to the pool requires a valid Whittier pool pass. Passes will be electronic. Registration can be completed at whittier.cellbadge.com/Register .
    2. Guest admissions. Six (6) guests are allowed per Whittier household per day. The adult Whittier member must pay with a check or use an electronic guest pass for each guest and is responsible for their guest’s behavior at all times while at the pool. Each electronic 10-punch guest pass is $15.00.
    3. Children’s admissions. An adult (to include a person 16 years of age or older) must accompany any child who is less than 10-years old. Children between the ages of 10 and 15 may be admitted without an adult provided that they pass a swim test administered by a guard.
    4. Refusal to admit for health or safety reasons. Individuals who are bleeding, wearing bandages and/or with skin abrasions, colds, inflamed eyes or exhibiting other types of possibly contagious infections and any individuals who appear under the influence of alcohol or drugs will not be admitted.
    5. Suspended persons. Persons suspended from any Whittier pool for violation of these regulations shall not be admitted to any other Whittier pool. All pool managers will report any attempt by a suspended pass holder to enter their pool to the WCAB.
  3. Chair lifts, for pool entry, are available at each pool for those that require assistance.
  4. County Health regulations: The Frederick County Board of Health requires that all persons must take a cleansing shower prior to entry to the pool area. Moreover, non-toilet trained individuals must wear approved “swimmer’s disposal pants”.
  5. Swimwear: Appropriate swimwear must be always worn. The pool manager has discretion to decide what is appropriate.
  6. Swimming and pool accessories: Water wings or other “flotation devices” will be permitted, provided that a person wearing such devices is supervised by an adult who will remain, always, “within arm’s reach” of the person with such devices.
  7. Off-Limits Areas: Only pool staff or equipment-related individuals shall be permitted in the filter room area, on the guard stands, or behind the sign-in desk. No persons will be permitted in the lifeguard station except in the case of an emergency.
  8. Wading Pool Use: An adult must always accompany children in the wading pool areas and be “within arm’s reach” at all times of such children. The wading pool is restricted to children under five years old and their accompanying adults.
  9. Permitted Items or Activities at the option of the Pool staff (based on pool crowd size or other factors in the sole discretion of the staff):
    1. Face masks, snorkels, and swim fins.
    2. Swimming games.
    3. Use of soft textured balls such as “beach balls”, “nerf balls” or soft “small footballs”
    4. A lap lane for straight-line swimming only if requested between 5 PM to 7 PM on weekdays at Cobblestone and Greenleaf. A dedicated lap lane will be always located at the Wetherburne pool.
  10. Non-Permitted Items or Activities in Pool Areas at all times:
    1. Non-swimmers in pool sections designated as deep water.
    2. Pets of any kind.
    3. Glass, glass face masks, or sharp metal objects.
    4. Eating or drinking within seven (7) feet of the pool’s edge
    5. Consumption of alcoholic beverages or illicit drugs.
    6. Smoking, chewing gum, or tobacco
    7. Spitting or spouting of water or nose blowing in the pool
    8. Wheeled vehicles or objects, except for baby carriages or strollers. Wheelchairs are exempt from this category.
    9. Persons who become injured with bleeding or skin abrasions remaining in the pool.
    10. Playing, swinging, or sitting on ladders.
    11. Running, pushing, wrestling, fighting, splashing, “horseplay” or unruly behavior that does or can interfere with other persons.
    12. Sitting on, hanging from, or diving over float lines.
    13. Absolutely no diving is permitted.
    14. Climbing on, loitering around, or playing on guard stands.
    15. Use of footballs, baseballs, softballs, golf balls, soccer balls, and the like in or around the pool.
    16. Discarding, throwing, or leaving any trash, cans, and bottles other than into designated receptacles.
    17. Misuse or vandalism of pool-side equipment
    18. Lewd acts, abusive behavior, or profane language directed by anyone to anyone else.
    19. Failing to follow a directive by a pool staff member, interfering with or preventing the pool staff’s performance of duties, or public disrespect to a pool staff member.
    20. Use of water pistols, super-soakers, or any type of toy used to project water are not permitted in or around the pool.
  11. Pool Scheduling and special use:
    1. Rest period-Lap Lane Swimming Only. The last 15 minutes of each full hour the pool is open (except the final hour of the day) will be set aside for a rest period and lap lane swimming only.
    2. Unscheduled closings. The pool facility may be closed, at the sole discretion of the pool manager, or as required by Frederick County rules, due to an issued local severe weather warning, thunder or lightning observed, rain, air temperatures below sixty-five (65) degrees Fahrenheit, operational breakdown of pool equipment, or lack of staff. Please check with Pool Company for the current status.
    3. Special events. The WCAB has authority to modify posted hours for special use purposes that it duly approved.
  12. Use of pool-side furniture: Benches, tables, umbrellas, lounges and other chairs are available on a first come, first served basis. Equipment users are prohibited from reserving items for persons not present and from leaving equipment unused for an extended period of time while a demand exists for such items by other patrons.
  13. Unlawful acts subject to legal enforcement: Any unauthorized or illegal use of the pool facilities by any person(s) will be fully prosecuted of the law. Any unauthorized person(s) found inside the pool enclosure or bathhouse at times when the pool has been closed will be prosecuted for trespassing and subject to suspension by the WCAB.
  14. Approach roads and adjacent areas to the pool: Association members, their family and guests should drive slowly and safely on roads in the vicinity of pools, on driveways leading to, and in pool parking lots. Pool parking lots are dedicated for use by pool patrons’ vehicles. Parked vehicles in these lots which are clearly not used for that purpose (such as unlicensed vehicles, junk vehicles, boats, trailers, trucks) or at times other than hours of pool use will be subject to towing as specified in the “Policy for Vehicle Parking Violations”. Parking lots and certain land adjacent to the pool are Whittier Common Areas and misuse of them will be subject to allowable remedies available to the Board by applicable law and governing documents.
  15. Limitation of risks:
    1. Personal Property. Neither the Whittier Community Association, its management company nor the Association’s pool company is responsible for the loss or damage to personal property. Items left at the pool will be properly disposed of on a weekly basis.
    2. Persons. All persons using the pool do so at their own risk. Neither the Whittier Community Association, its managing company nor the Association’s pool company is responsible for any injury or accident connected with pool use.
  16. Enforcement Policy: Most initial enforcement problems should usually require only a verbal reminder or friendly admonition to resolve. Suspension of pool privileges is a serious matter and will be enforced as follows:
    1. Pool staff authority to suspend. (1) LIFEGUARDS. A lifeguard has the authority to suspend any patron for any violation of any of the regulations herein for twenty-four hours, subject only to review of the pool manager on duty at that time. (2) MANAGER. A manager (or assistant when the manager is absent) has the authority to suspend any patron for any violation of the listed regulations, subject only to review by the WCAB, for up to one week. (3) IMPLEMENTATION AND FORFEIT. If a pass-holder is suspended, his pass will be invalid.
    2. WCAB authority to suspend: (1) FOR POOL OR NON-POOL VIOLATIONS The WCAB has the authority to suspend the right of any patron to use the pool for violation of any of these regulations for up to 30 days as well as for other published rules and regulations not related to pool use (2) FOR PAST DUE ASSESSMENTS The WCAB has the authority to withhold pool passes from families or suspend their right to use the pool should the family be past due in any assessment until the past-due condition is resolved.
  17. Questions concerning rules and regulations: Please direct rules and regulations questions to the Pool Manager, WCAB, or Vanguard Management (Nancy Keen, Community Manager at 301-540-8600).
  18. Regulation changes: The WCAB can determine when a change is needed and have the matter placed on the agenda and/or discussed at the next Board meeting so that owners have an opportunity to be heard. Once a decision has been made by the WCAB, posting the changed regulation at the pools will constitute sufficient notice to patrons that the regulation is effective.

Statement of Understanding; Assumption of Risk; Waiver of Liability and Indemnification Agreement

I enter into this Statement of Understanding; Assumption of Risk; Waiver of Liability and Indemnification Agreement (“Agreement”) with Whittier Community Association, Inc., (the “Association”) for the privilege to use the Swimming Pool and any related facilities and/or equipment (collectively, the aforementioned Swimming Pool, facilities, and equipment are referred to herein as “Facilities”). Use of the Facilities and/or any of the equipment therein or thereon is at the sole risk of the person using such Facilities and/or related equipment, and such use is subject to any rules and regulations of the Association regulating the use thereof. Further, pursuant to Maryland Governor Lawrence J. Hogan’s (“Governor Hogan”) Proclamation dated March 5, 2020, Maryland is currently under the State of Emergency due to the number of confirmed novel coronavirus (“Covid-19”) cases in Maryland. Covid-19 is extremely contagious. Pursuant to the Center for Disease Control, Covid-19 is believed to be spread largely through person-to-person contact, such as between persons who are within close contact with one another or through respiratory droplets released by an infected person, which are then inhaled by another person. The Association has put preventative measures and enhanced cleaning policies in place for the Facilities and related equipment to prevent the spread of Covid-19, but the Association cannot guarantee that Owners and residents or other persons who use the Facilities and/or related equipment will not become infected with Covid-19. It is possible that using the Facilities and/or related equipment can expose you, your family, and other people you may come into contact with Covid-19. You agree and acknowledge the following:
  1. I affirm that I will not use the Facilities and/or related equipment if I, or any member of my household, have experienced the following symptoms within the ten (10) days preceding use of the Facilities and/or related equipment:
    1. Fever; or
    2. Cough; or
    3. Shortness of breath; or
    4. New loss of taste or smell; or
    5. muscle or body aches; or
    6. sore throat; or
    7. diarrhea; or
    8. nausea or vomiting
  2. I affirm that neither I nor any members of my household have been exposed to someone with a suspected and/or confirmed case of Covid-19 within the past fourteen (14) days. Further, I agree that if I or any member of my household is exposed to someone with a suspected and/or confirmed case of Covid-19 then neither I nor any member of my household will use the Facilities and/or related equipment until after fourteen (14) days from the date of potential exposure to Covid-19. Notwithstanding the foregoing, in accordance with current CDC guidelines, I or a member of my household may use the Facilities and/or related equipment prior to the expiration of the 14-day period set forth in the preceding sentence if I or said member of my household has tested positive and recovered from Covid-19 in the previous 3 months of exposure, or if I or said member of my household has a negative test on or after 5 days of quarantine from the date of exposure.
  3. I affirm that neither I nor any member of my household has been diagnosed with Covid-19, or, if I have been diagnosed with Covid-19, I affirm that I will not use the Facilities unless:
    1. I have had improvement in my respiratory symptoms, and I have not had a fever within the 72 hours preceding use of the Facilities and/or related equipment, and I have not used fever-reducing medicine; and
    2. At least ten (10) days have passed since I first experienced symptoms related to Covid-19.
  4. I further affirm that if I am diagnosed with Covid-19 after execution of this Agreement, I will not use the Facilities and/or related equipment until I meet the requirements set forth in Section 3 above.
  5. I affirm that I have read and will abide by the Association’s rules and regulations and any procedures when using the Facilities and/or related equipment such as, but not limited to, the social distancing guidelines and sanitation policies and procedures. I understand that the risk of becoming exposed to or infected by Covid-19 at the Facilities and/or by use of the related equipment may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the Association. By executing this Agreement below, I acknowledge the contagious nature of Covid-19 and voluntarily assume the risk that my family, including child(ren) and other household members, may be exposed to or infected by Covid-19 while on site at the Facilities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that despite any preventative measures the Association has put in place, the Association cannot guarantee a virus-free environment, and that I or any member of my household or any person that I may come into contact with after using the Facilities and/or related equipment may be exposed to Covid-19, which may result in quarantine, serious illness, disability, or death.
  6. I understand and agree that the Association, its agents, servants, employees, insurers, members, directors, officers, managers, and successors and assigns assume no liability for damage or loss of any personal property brought into or onto any of the Facilities by any user of the Facilities and/or related equipment, and/or into or onto any part of the real property owned by the Association including, without limitation, parking areas.
  7. With full awareness and appreciation of the risks involved and in consideration for use of the Facilities and/or equipment therein or thereon, I, for myself and on behalf of my family, spouse, child(ren), estate, heirs, executors, administrators, assigns, and personal representatives and anyone else who might have a claim by reason of my injury, illness, or death, or the injury, illness, or death of the minor child(ren) identified in this Agreement (“Minor” or “Minors”) in connection with the use of the Facilities and/or equipment therein or thereon including without limitation, a Covid-19 infection, hereby waive and forever release the Association, its agents, servants, employees, insurers, members, directors, officers, managers, and successors and assigns (the “Released Parties”) from any and all liability, claims, demands, actions, causes of action, damages or suits at law or in equity (“Claims”), directly or indirectly arising out of or related to any loss, claims for personal injury, death, property damage, loss of property, medical expenses and/or loss of services, that may be sustained by me or the Minor or Minors identified in this Agreement related to the use of the Facilities and/or the equipment therein or thereon including, without limitation, a Covid-19 infection, whether caused by my or said Minor’s use of the Facilities and/or related equipment, any third-party using the Facilities and/or related equipment, or otherwise on account of or in any way relating to or arising out of use of the Facilities and/or related equipment. I understand that this release includes any and all Claims on behalf of myself, on behalf of my minor child(ren), and my household related use of the Facilities and/or related equipment including, without limitation, any Claims relating to Covid-19.
  8. I hereby agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorneys’ fees) arising either directly or indirectly from or related to any and all third-party Claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my, or my family, spouse, child(ren), Minor or Minors identified in this Agreement, and/or any member of my household’s use of the Facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise and specifically including, but not limited to, Claims related to COVID-19.
  9. I acknowledge that I have received and read a copy of this Agreement. I understand that I have the right to retain legal counsel before executing this Agreement, and I have either consulted with legal counsel, or have voluntarily elected not to do so. I agree that I understand and will fully comply with the terms stated herein.
I UNDERSTAND THE RISKS OF USING THE FACILITIES AND I HAVE CAREFULLY READ, UNDERSTAND AND VOLUNTARILY ACCEPT THE TERMS OF THIS AGREEMENT. I UNDERSTAND THAT I AM SURRENDERING CERTAIN LEGAL RIGHTS. I HEREBY WARRANT THAT I AM 18 YEARS OF AGE OR OLDER AND THAT I HAVE LEGAL AUTHORITY TO ACT ON BEHALF OF THE BELOW NAMED MINOR(S). I AGREE, ON MY OWN, AND ON BEHALF OF EACH SUCH MINOR, TO THE TERMS AND CONDITIONS IN THIS DOCUMENT.
